What is a guardianship for an adult?

In Washington, a guardianship for an adult is a legal arrangement that allows an individual known as a guardian to make decisions on behalf of an adult who is unable to make informed decisions on their own. The guardianship can be limited to specific areas, such as finances and medical decisions, or it can give the guardian wide-ranging control over all aspects of the adult’s life. In order to appoint a guardian, a court must determine that the adult lacks the capacity to make fully informed decisions and that a guardianship is in the best interest of the adult. The guardian is typically someone who has a close relationship with the adult, such as a family member, or another trusted individual. When appointed, the guardian has a fiduciary responsibility to act in the best interest of the adult. This may include ensuring that the adult’s basic needs are met, managing their finances, arranging for medical care, and signing legal documents. There are several different types of adult guardianships in Washington. A general guardianship is the most common type, but there are also temporary guardianships, limited guardianships and guardianships for those with developmental disabilities. The type of guardianship that is most appropriate will depend on the individual’s particular needs. In all cases, however, the guardianship is intended to protect the adult and ensure they receive the care and support they need to make informed decisions.
