How can a guardianship be terminated?

In the state of Georgia, guardianship of an individual can be terminated in different ways depending on the situation. Guardianship is often terminated when the ward or individual turns 18 and is legally able to make decisions on their own behalf. At this age, the individual is recognized as an adult in the eyes of the law and is no longer legally required to be under the guardianship of another person. Guardianship can also be terminated due to the death of the ward, or when the ward has been declared to be mentally competent and able to make decisions for themselves. In this case, a court order is required to terminate the guardianship. In some cases, the guardian can also voluntarily relinquish their guardianship, or agree to end it due to a change of circumstances in the ward’s life. This typically requires that the guardian and the ward both attend a court hearing as the guardian is responsible for the ward until the final order is issued. Finally, guardianship can also be terminated due to neglect or abuse. A guardianship can be revoked when the guardian is found to have violated the law or acted in a way that is not in the best interest of the ward. In severe cases, criminal charges may also be brought against the guardian. It is important that the proper processes are followed when terminating a guardianship in order to ensure that the best interests of the ward are protected and that the termination process is legally binding.
