What is an emergency guardianship?

An emergency guardianship is a legal process by which courts can appoint a guardian for a minor without any prior notice or consent. This type of guardianship is usually granted when it is necessary to protect the welfare of a minor. In Alaska, an emergency guardianship is granted by a Superior Court judge, and it is usually granted in cases involving domestic violence, abuse, neglect, or abandonment. In order to be granted an emergency guardianship, the petitioning party must file an affidavit with the court that explains the situation and why guardianship is necessary. The court must also determine that the emergency guardianship is in the best interests of the minor and that immediate action is needed. In addition to the affidavit, the court may also receive testimony from witnesses, social workers, and/or medical professionals. Once the court grants an emergency guardianship, the guardian is granted the authority to make decisions regarding the minor’s health and well-being. This includes the power to make decisions about the minor’s education, finances, religious upbringing, and more. To terminate an emergency guardianship, the court must determine that the emergency situation has been resolved. Once the emergency guardianship is terminated, the court may also order the appointment of a permanent guardian for the minor.
