What is an emergency guardianship?
An emergency guardianship is a form of guardianship that is put in place in Georgia when a minor is in immediate danger. It is usually used when the parents of the minor cannot be found, or cannot be contacted. Emergency guardianships can be requested by any responsible adult, such as a teacher, doctor, or social worker, that is aware of the situation. In Georgia, an emergency guardianship is a temporary guardianship, lasting up to 14 days, and it can be extended for seven days at a time for up to three months. During the emergency guardianship, the guardian is given the same rights and responsibilities as a regular guardian. The emergency guardian has the authority to make decisions about the minor’s medical care, education, and other types of care. Once the emergency guardianship is in place, the minor’s parents or other legal guardians must be located and notified of the guardianship. The emergency guardian must also file a petition with the court to request a regular guardianship. This petition must be heard within 21 days of the emergency guardianship being granted. Emergency guardianships are put in place with the best intentions of keeping the minor safe. It is important to remember that emergency guardianships are only meant to be used in very specific circumstances in Georgia, and only when there is an immediate danger present.
