What is an emergency guardianship?

An emergency guardianship is a legal action that is taken to provide a minor child with temporarily protection and care in the event of an emergency or urgent situation in Texas. This type of guardianship is granted by a court in the event of a serious emergency, such as when the parents are unable to adequately provide for the safety and well-being of the minor child. In an emergency guardianship, the court appoints a temporary guardian to assume responsibility for the child’s protection and care. This guardian is given the same duties and responsibilities as those provided to a permanent guardian and is appointed on an emergency or temporary basis. The court has the authority to determine who will serve as the emergency guardian, which may be someone close to the child such as a family member, or it may be an individual appointed by the court in charge of the local child protective services. The court can also grant additional powers to the emergency guardian if needed, such as the authority to make decisions regarding the child’s medical care or education. The guardian is usually appointed until the situation is resolved or until the court rules that the guardianship should be removed, or until a more permanent guardianship is granted. In Texas, an emergency guardianship is often only granted when there is an imminent danger to the child’s safety and well-being, or when the child’s parents are unable to provide adequate protection and care for the child. An emergency guardianship can only be granted for a defined period of time and it is important to understand that this type of guardianship is not the same as permanent guardianship.
