What are the legal requirements for guardianship?
In Kansas, guardianship is a legal process in which a qualified individual or organization is assigned to manage the personal and/or financial affairs of someone who is incapable of doing so. This legal relationship is established by a court order, typically issued by a Probate Court. To be appointed as a guardian, one must meet certain eligibility requirements. These requirements vary from state to state, but in Kansas, the requirements are determined by the state’s probate code. Generally, a guardian must be at least 18 years of age, a resident of the state, and of good moral character. Guardians must also be reasonably suited to act in the best interest of the person they are assigned to manage. In some cases, a guardian may be assigned the authority to manage the person’s financial affairs, as well as their medical and/or personal decisions. To be appointed as a financial guardian, the applicant must provide the court with a financial plan that outlines how the funds under their management will be used. The court will also look for evidence that the guardian is capable of handling the finances responsibly, and that they will act in the person’s best interest. When a court appoints a guardian for a person, it also set duties and responsibilities that the guardian must adhere to. These duties include managing the person’s decisions, communications, and physical needs as well as administering their finances. Additionally, the guardian must ensure that the person is provided with adequate care and support, and must provide the court with an annual report demonstrating their compliance with their duties and responsibilities.
