What are the legal requirements for guardianship?
In Kansas, guardianship is a legal process in which a qualified individual or organization is assigned to manage the personal and/or financial affairs of someone who is incapable of doing so. This legal relationship is established by a court order, typically issued by a Probate Court. To be appointed as a guardian, one must meet certain eligibility requirements. These requirements vary from state to state, but in Kansas, the requirements are determined by the state’s probate code. Generally, a guardian must be at least 18 years of age, a resident of the state, and of good moral character. Guardians must also be reasonably suited to act in the best interest of the person they are assigned to manage. Additionally, the guardian must ensure that the person is provided with adequate care and support, and must provide the court with an annual report demonstrating their compliance with their duties and responsibilities.
