How often is a guardianship review required?

In South Carolina, guardianship reviews are required every year. The law states that any person appointed as a guardian must conduct a review and file a report with the court each year on the first anniversary of the guardianship. This is known as a “guardianship review.” The review should include a physical examination of the ward, an examination of the ward’s financial records, and an assessment of the ward’s current living arrangements. The review must also include an evaluation of the guardian’s performance, an opinion as to whether the guardianship is still necessary, and a recommendation as to whether the guardianship should be continued or terminated. The court is responsible for holding guardianship review hearings. These are held to review the guardian’s performance and the financial and physical condition of the ward. The court can also make changes to the guardianship, if necessary. For example, it may decide to modify the guardianship to better serve the ward’s interests. Additionally, guardians may also be asked to submit financial reports, accountings, and other documents pertaining to the guardianship. The court generally reserves the right to conduct regular reviews of the guardianship at any time, even if it is not the time for the annual review. If the court finds that a guardian has not adequately fulfilled their obligations, it may remove the guardian and appoint a new one.
