Who is responsible for making medical decisions when there is a guardianship in place?

When a guardianship is in place in North Dakota, the guardian is responsible for making medical decisions on behalf of the ward. The court appoints a guardian when it is determined that an individual, commonly referred to as the ward, is unable to make decisions about his or her well-being due to a physical or mental disability. This includes decisions regarding the ward’s medical care, as well as decisions about what activities the ward takes part in. When it comes to medical decisions, the guardian has the responsibility to make decisions that are in the best interests of the ward. With the help of medical professionals, the guardian is able to assess the ward’s medical situation and make an informed decision based on the best available evidence. The guardian should also consider the ward’s preferences when applicable and appropriate. It is important to note that guardianships are not absolute rights and can be revoked or modified by the court at any time. The ward can also petition the court to have the guardianship removed if they feel that their rights are being violated. Additionally, family members of the ward may petition the court to replace the guardian if they feel the guardian is not acting in the best interests of the ward.
