What is a guardian ad litem?
A guardian ad litem (GAL) is a person appointed by the court to represent the best interests of a minor child or an incapacitated adult in guardianship proceedings in Florida. GALs are sometimes referred to as “court-appointed special advocates”. A GAL is appointed by the court when there is no suitable parent or other relative to act as a guardian. In most cases, the court will appoint a GAL to represent the child’s or incapacitated adult’s legal interests. The GAL is expected to work with the court to ensure that the proposed guardian is suitable and that the ward’s best interests are being served. The GAL is responsible for investigating the situation and preparing a report for the court. The GAL’s duties may include interviewing parties involved in the guardianship, gathering documents, and visiting with the ward. In their report to the court, the GAL will typically provide a recommendation for the proposed guardian. Finally, the GAL may serve as a watchdog for the court, advocating for the ward’s best interests even when the ward is not present. This can include attending court hearings, monitoring the guardian’s progress, and making sure the guardian is meeting their legal obligations. While the GAL does not have the same legal authority as a guardian, they still perform an incredibly important role in protecting the rights of vulnerable children and adults. GALs are expected to provide an unbiased point of view and act independently of the court in their recommendations.
