What is a permanent guardianship?
A permanent guardianship is a legal arrangement under California guardianship law that grants an adult (called a guardian) the legal authority to make decisions for a minor child. This may include decisions about the child’s education, healthcare, and other matters. The court must grant a permanent guardianship for a valid reason, such as abandonment, abuse, or neglect of the child. A guardianship does not take away parental authority. The court must first determine that the child’s parents are unable or unwilling to care for them before granting a permanent guardianship. The guardian typically has the authority to make decisions about the child’s living arrangements and medical care, among other things. They can also manage the child’s finances, including providing money for their day-to-day needs. The guardian is expected to follow any terms of the guardianship order that are set by the court. Permanent guardianship in California is a serious step and should be considered only when there is no other option. It is important to seek the advice of a lawyer if you have questions about guardianship or believe it may be an appropriate arrangement for a child.
