What is a permanent guardianship?
A permanent guardianship is a legal arrangement where a court grants an adult the authority to care for a minor child. In Hawaii, any individual over the age of 18 can be appointed as a permanent guardian to a minor child who is a resident there. The appointment must be approved by a court’s order, and the guardian will take on some of the parental responsibilities of caring for the child. The permanent guardian has the right to make decisions on behalf of the child, such as those related to their schooling, medical care, and well-being. The guardian has a legal obligation to care for the child’s physical and emotional needs and must provide a safe and secure home environment. In most cases, the guardianship will be in place until the child turns 18. The task of the guardian is to provide for the child’s needs, and that may include taking them to activities, helping them with school issues, and providing them with emotional and social guidance. The guardian may also need to represent the child in court hearings or provide a safe home and serve as a legal representative in financial matters. Generally, guardians take on full responsibility for the care of a child and must act in the best interest of the child at all times.
