What is a permanent guardianship?

A permanent guardianship is a legal responsibility in Iowa where a third party, known as a guardian, is appointed to take care of another person, known as a ward. The purpose of a permanent guardianship is to provide long-term care and decision-making for the ward, who may be legally unable to take care of themselves due to age, disability, or other circumstances. In Iowa, a permanent guardianship legally gives the guardian the same legal authority as a parent has over a minor child. This includes the right to make medical, financial, and other important decisions on behalf of the ward. In order for a permanent guardianship to be put in place in Iowa, a guardianship petition must be filed with the court. This petition must include documentation to prove why the guardianship is necessary and should include recommendations from medical or mental health professionals if applicable. Once a permanent guardianship is put in place, the guardian is considered legally responsible for the ward. This responsibility includes providing physical care to the ward, such as housing, food, and medical care; overseeing the ward’s finances; and making decisions about the ward’s education and lifestyle. The ward has the right to challenge the guardianship at any time. If the guardianship is no longer needed or if the ward feels that the guardian is not acting in their best interest, they can request that the court terminate the guardianship and appoint another guardian.
