What is a permanent guardianship?
A permanent guardianship is a legal relationship that is established when a court appoints an adult—known as the guardian—to assume the legal responsibility and authority to care for a minor child or an incapacitated adult. In the State of New Jersey, this type of guardianship is often referred to as plenary guardianship. A permanent guardian is legally responsible for providing the ward (the person who the guardianship is established for) with physical and emotional care and protection. This includes providing a safe and healthy home, a suitable education, and medical and psychological care. The guardian also has the authority to make decisions and take action on behalf of the ward. Although a permanent guardianship is intended to be long-term (it can even last the entire life of the ward), a guardian’s authority is not absolute. The court retains the right to review the guardianship to ensure that the ward is receiving proper care. The court may also modify or terminate a permanent guardianship if necessary.
