What is a permanent guardianship?
A permanent guardianship is a legal arrangement in which an adult is appointed by the court to act as the guardian of a minor child in North Carolina. The guardian has the legal right and responsibility to make decisions regarding the minor, such as providing for medical care, continuing education, and caring for the child’s needs. The appointed guardian must attend to the child’s emotional, physical, and educational needs, and act in the best interests of the child. A permanent guardianship typically occurs when the biological parent(s) are deemed unfit or otherwise unable to provide adequate care. It can also be established when a child is adopted. In order to be appointed a permanent guardian, a person must be of good moral character with the ability to provide the child with a safe and stable home. The court may also require the guardian to submit to a background check and provide updated financial information as part of the guardianship process. Once the guardianship process is complete, the court will issue a permanent guardianship order. This order will provide the legal authority for the guardian to make decisions on the child’s behalf and will outline the guardian’s rights and responsibilities. In some cases, the court may also set a trial period during which the guardianship arrangement can be monitored to ensure the best interests of the child are being served.
