What is a permanent guardianship?

A permanent guardianship is a legal relationship between an adult and a minor in which the adult, also known as a guardian, is responsible for making decisions on behalf of the minor. In Ohio, a permanent guardianship can be granted by the court when the child’s parent or parents die or become incapacitated due to a physical or mental disability. The guardian is responsible for making decisions regarding the welfare of the child, including educational decisions, financial decisions, and medical decisions. The guardian is also responsible for providing a safe and secure home for the child. In Ohio, only an adult can be named a guardian, and the adult must be at least 18 years old and have no felony convictions. Once the guardianship is permanent, it lasts until the child turns 18. The guardian is legally obliged to look after the child’s best interests. In some cases, the guardian may need the court’s permission before making certain decisions, such as those related to the child’s education, health care, or finances. The court will often appoint a guardian ad litem, or GAL, to represent the child’s best interests in the court proceedings, and to make sure the guardian is acting in the best interest of the child.
