Can a minor choose their own guardian?

In Alaska, a minor cannot choose their own guardian, as a guardian is appointed by the court. Generally, when parents are unable to adequately care for their child, the court will step in and appoint a guardian. The court’s role is to keep the minor’s best interests in mind when appointing a guardian. This means that the court will take into consideration the child’s preferences, lifestyle, and support system when making its decision. The court will typically consider a variety of factors, including the minor’s age, the proposed guardian’s relationship to the child, and the proposed guardian’s capacity to provide adequate care. If the minor is old enough to express a preference, the court will consider the child’s opinion when making its decision. However, the court has the final say in appointing a guardian and the minor’s preference may not be the deciding factor. The court will also consider any other special circumstances surrounding the case when making its decision. For example, if the proposed guardian has criminal records or a history of domestic violence, the court may decide that this person is not suitable for the position. Additionally, if there are multiple suitable candidates, the court may consider the minor’s relationship with each of them to determine which individual should serve as guardian. Ultimately, the court must take into consideration all of the relevant factors when making its decision, but a minor cannot choose their own guardian in Alaska.
