How is a guardian's performance evaluated?

In Arkansas, the performance of guardians is evaluated by courts on an annual basis. The court will usually require the guardian to file an annual guardianship report, which must include an inventory of the ward’s property and assets, an accounting of the ward’s income and expenses, and a statement of any changes in the ward’s condition. The court may also hold a hearing to review the guardianship. At the hearing, the court will consider any information or evidence presented by the guardian, the ward, or any interested party about the guardian’s ability to manage the ward’s affairs. The court may also require the guardian to submit to a criminal background check. If the court finds that the guardian is not properly performing his or her duties, the court may order the removal of the guardian or take other necessary action.
