How is a guardian's performance evaluated?

In North Dakota, guardians are expected to fulfill their duties and responsibilities step by step and in compliance with the procedures of the courts. Guardians are required to provide an annual report to the court, detailing a list of tasks they have completed, the amount of time spent and the status of their ward’s finances. Additionally, the court reserves the right to call upon the guardian during annual reports to answer questions as it relates to their guardianship. Additionally, the court also uses its own evaluation system for a guardian’s performance. The court reserves the right to inspect any financial or legal documents related to the guardianship and investigate any issues which may arise from their review. In addition, the court has the authority to summon the guardian and may require them to submit to an audit process to assess how effective they have been in fulfilling their duties. The court may also order a professional evaluation from an outside expert to assess a guardian’s performance. Finally, the court may also appoint a “guardian ad litem” to evaluate the guardian’s performance. A guardian ad litem is an independent advocate assigned by the court to investigate and evaluate a guardian’s performance. Their findings are then reported to the court. The court will consider all of the evidence and findings before making a determination about the guardian’s performance.
