What is a voluntary guardianship?

A voluntary guardianship is a type of guardianship that is given when the child’s parents or guardians request it. Typically, this is done when the parents or guardians are unable to provide adequate care for the child or if the child is facing special needs that require additional help. In Alaska, a voluntary guardianship is established when a petition is filed with the court. The court then determines whether or not the guardianship is in the child’s best interest. Generally, the court will look at the child’s physical, emotional, and educational needs, the capacity of the proposed guardian, and the nature of the relationship between the child and the proposed guardian. Once the court decides that a guardianship is in the child’s best interest, the court must issue an order that specifies the duties and responsibilities of the guardian. These duties may include providing care, support, and direction for the child, making decisions for the child, and managing the child’s property and financial affairs. The guardian also needs to make sure that the child has access to education, medical care, and other necessary services. Voluntary guardianships are usually temporary, as they are typically established until the child reaches a certain age or until the parent or guardian is able to resume care of the child. At that time, the guardianship will be terminated, and the child will be returned to the parent or guardian.
