Who is eligible for guardianship?

In Colorado, anyone who is a legal resident of the state and is 18 years old or older can become a guardian. This includes parents, grandparents, legal guardians, step-parents, or even adult siblings over the age of 18 who are legally responsible for the wellbeing of a minor. Guardians are responsible for making decisions on behalf of the minor, such as where they live, what medical care they receive, their education, and other important decisions. Guardians must be of legal age, in good mental and physical health, and able to provide a safe and secure environment for the minor. In some cases, a court may appoint a guardian to oversee the rights and welfare of the minor. This can happen when a parent is deemed unfit to care for their child, if the child is an orphan, or if the parents pass away. The court-appointed guardian must also be of legal age, in sound physical and mental health, and able to provide a safe and secure environment for the minor. In Colorado, any qualified adult can be appointed guardian of a minor, but the court will ultimately decide who is best suited for the role. The court considers the needs of the child, and the ability of the prospective guardian to meet those needs, when making a decision.
