Who is eligible for guardianship?
In North Dakota, a person is eligible for guardianship if they cannot manage their own affairs, or need to have their affairs managed for them. Generally, this includes people who have physical and/or mental impairments that prevent them from caring for themselves and making decisions. Examples of impairments that may make a person eligible for guardianship include intellectual disabilities, developmental disabilities, dementia, or mental illness. Minors can also be eligible for guardianship. In North Dakota, guardians are appointed for minors in cases where the child’s parents are incapacitated or unable to handle their affairs. This could be because the parents are unable to make decisions for their child due to mental or physical impairment, or are incarcerated or overseas. In some cases, guardians can also be appointed for minors for financial or educational reasons, such as when the child has inherited a large sum of money or is enrolled in college. In North Dakota, persons over the age of 18 can also be eligible for guardianship. This is typically due to a physical or mental impairment that keeps them from making informed decisions on their own. Additionally, if they are unable to understand the significance of a decision they are making, then they are eligible for guardianship. In all cases, before a person can be appointed as a guardian for someone else, they must undergo a background check and receive court approval. The court will then review the case and decide whether or not guardianship is necessary.
