What is involved in establishing a guardianship?
In order to establish a guardianship in Ohio, a few steps must be taken. First, the person seeking guardianship must file a petition in the probate court. This petition includes information about the proposed guardians, the person for whom the guardianship is sought (the ward), and the reasons why a guardianship is necessary. After the petition is filed, the court will typically schedule a hearing to determine if the guardianship is necessary. The proposed guardian will have to appear at the hearing and answer any questions the court may have. At the hearing, the court will also consider evidence, such as financial or medical information, that supports the need for a guardianship. The court may also appoint a guardian ad litem, who is an independent attorney, to represent the interests of the ward. The guardian ad litem will conduct an investigation and make a recommendation to the court about the guardianship. If the court determines that a guardianship is necessary, it will then issue an order granting the guardianship. This order will identify the guardians, the rights and duties they will be responsible for, and any other conditions the court wishes to impose. Once the order has been issued, the guardians must accept the responsibilities outlined in the order or ask the court to modify the terms of the guardianship.
