Can a guardian be appointed without a court order?

In Nevada, a guardian can be appointed without a court order in certain circumstances. In Nevada, a guardianship is referred to as a "guardian ad litem" or "GAL". This type of guardianship is for minors and adults who are unable to care for themselves, usually due to mental or physical disabilities. In a GAL guardianship, the court may appoint someone to act as a guardian without a court order. This is known as a "voluntary guardianship." In order for a GAL to be appointed without a court order, certain criteria must be met. First, the minor or adult must have a disability or disease that makes him or her unable to provide adequate care for themselves. Second, the proposed guardians must demonstrate competency in taking care of the minor or adult. Third, the proposed guardians must demonstrate that they are not financially profiting from the guardianship or using the guardianship for their own benefit. Finally, the proposed guardians must demonstrate that they are willing to accept the responsibility of being a guardian without court order. A voluntary guardianship, without a court order, is generally less formal than a court-ordered guardianship. Still, the guardian is held responsible for all of the same duties and responsibilities of a court-appointed guardian, including providing care and resources for the ward. If the guardian is found to be neglecting their duty, a court can be petitioned to remove the guardian and appoint a new one.
