What is an informal guardianship?
An informal guardianship is a form of guardianship that does not involve a court order. It is typically the result of parents agreeing to allow a third party to become a guardian for their minor children. This type of guardianship is seen as a way to provide a safe and stable home environment for the children without going through the more formal and lengthy process of a court-ordered guardianship. In Pennsylvania, an informal guardianship is created when a parent or parents agree to the guardianship of a minor child and give written permission to the third party. This agreement is signed by both the parent or parents and the third party, and each must also be notarized by a notary public. The agreement must be filed with the local court. Once filed with the local court, the adult with whom the minor child will reside will receive the legal authority to make decisions for the minor child. This includes providing for the care and protection of the minor child, making decisions about education, and providing access to medical and dental care. Informal guardianships are temporary arrangements and the guardianship will end when the minor child turns 18 or if the court amends the order. The guardian will have to report to the court on an annual basis. This informal guardianship is not considered a custody order, and the parent or parents retain their parental rights.
