How is a guardianship revoked?

In Florida, guardianship of a minor or an incapacitated adult is revoked when the child turns 18 or the guardianship is no longer necessary. The guardianship can also be terminated or revoked in the event of death of the individual under guardianship or the guardian. The guardianship can also be revoked if the guardian does not fulfill the duties and responsibilities of a guardian or is found to be negligent or incompetent. The court may also revoke the guardianship if there is evidence of significant health and safety concerns, if the guardian fails to complete the financial and medical reporting requirements, if the guardian does not properly manage the financial resources of the ward, or if the guardianship is no longer in the best interest of the ward. The court will conduct an investigation to determine if the guardianship should be revoked. This may include a review of the guardian’s performance of his or her duties, an assessment of the ward’s best interests, and consideration of any reports, evidence, or testimony from witnesses or experts. The court may then decide to revoke the guardianship for any of the above reasons. If the guardianship is revoked, the guardian must follow the process to transfer guardianship rights to a new guardian or terminate the guardianship. The court must approve the transfer or termination of guardianship before it is finalized.
