How is a guardianship revoked?
In Nevada, a guardianship can be revoked in multiple ways. It can be revoked by court order, as decided by a judge. The court may decide to revoke the guardianship based on factors such as a change in the incapacitated person’s state of health or if the guardian is no longer able to fulfill their duties. The court may also revoke the guardianship if the person under guardianship is capable of making decisions for themselves. In some cases, the incapacitated person may submit a petition to the court asking for a revocation of the guardianship. In response, the court will hold a hearing to determine whether revoking the guardianship is in the person’s best interest. If the court decides that it is, the guardianship will be revoked. The court may also revoke a guardianship if the guardian fails to fulfill their duties, or if the guardian is found to be acting inappropriately towards the person under guardianship.
