What are the guardianship laws in my state?
In Kansas, guardianship laws are determined by a court of law and are based on the age, disability, and other circumstances of the individual in question. Generally, guardianship is a court-ordered arrangement for an individual who may not be able to handle their own matters due to age, a medical condition, or other disability. A guardian is responsible for making sure the individual has his or her needs met, such as adequate housing and medical care, and may also be responsible for making decisions on his or her behalf. The court may impose various forms of guardianship, including a guardianship for the person, a guardianship for the estate, and a guardianship for both the person and the estate. A guardianship for the person generally requires the guardian to make decisions related to the person’s health care, well-being, living arrangements, and other matters. A guardianship for the estate focuses on managing the individual’s financial assets, such as bank accounts, investments, and real estate. A guardianship for both the person and the estate covers both areas. The court may appoint either a family member, a close friend, or a professional guardian as the individual’s guardian. Before a court will appoint a guardian, the individual must be determined to be unable to make reasonable decisions about his or her care and/or finances. The individual must also be notified of the petition and be allowed to oppose the guardianship if desired. Furthermore, the court must review the guardian’s performance on a regular basis.
