What is the law on organ donation?

In California, individuals are allowed to donate organs for the purpose of medical transplant with the passage of the Uniform Anatomical Gift Act in 1984. This act states that any person, 18 years or older, can declare oneself to be an organ donor upon death. Because of this, it is important for individuals to communicate their wishes on organ donation with their families and/or medical professionals. Under the law, individuals can be added to the Donate Life California Organ and Tissue Donor Registry, which is a statewide database where individuals can record their wishes related to organ and tissue donation. California residents can also register their wishes when they apply for or renew their driver’s license or state identification card. Organ donation is at the discretion of the individual or their legal representative. If a person is unsure of their wishes, family members will be asked to provide consent prior to organ donation. For those individuals who have not expressed any wishes directly or through the registry, family members will have the right to make the decision regarding organ donation. Organ donation has helped to save thousands of lives and continues to provide hope to those in need. To ensure that organ transplants are safe and successful, the medical and legal communities strive to adhere to ethical, legal, and medical standards related to the harvesting and transplanting of organs.
