What is the law on long-term care?
In Florida, long-term care includes services needed by an individual who has a prolonged physical, mental, or developmental condition that could prevent the individual from performing daily activities. The law on long-term care in Florida is governed by the Long-Term Care Ombudsman Program. This program is designed to protect the rights of individuals receiving long-term care services in nursing homes, assisted living facilities, adult family care homes, and other long-term care settings. The program also helps ensure that individuals in long-term care settings receive the appropriate care and services, and are not subject to abuse, neglect, or exploitation. The program works to investigate and resolve complaints made by or on behalf of people receiving long-term care services. This includes providing information to individuals about their rights in regards to the care they receive, giving advice and support to those receiving long-term care services, and advocating on their behalf. The Long-Term Care Ombudsman Program also ensures that residents are not evicted from long-term care facilities without due process and that their rights to remain in the facility with dignity and safety are protected. Additionally, the program works to prevent financial exploitation and abuse by providing education, training, and technical assistance on the topic. The program oversees long-term care facilities and investigates complaints in an effort to ensure that individuals in long-term care settings receive the highest quality of care available.
