What are the legal requirements for medical marijuana?
In Oregon, medical marijuana is legal and is subject to special legal requirements. In order to legally possess and use medical marijuana in Oregon, a person must obtain a valid Oregon Medical Marijuana Program (OMMP) card from the Oregon Health Authority. In order to qualify for a card, a patient must have a qualifying medical condition and must be certified by a licensed physician. Qualifying medical conditions include Alzheimer’s disease, cancer, chronic pain, nausea, glaucoma, and more. Oregon’s medical marijuana laws also stipulate that a patient may only purchase medical marijuana from an Oregon Medical Marijuana Dispensary (OMMD). Patients and caregivers may also apply for growing and processing permits from the Oregon Health Authority. Patients may grow up to four plants at a time, while caregivers may grow up to six plants. Patients and caregivers can process the marijuana into edible items, tinctures, and topical products, but they may not sell or transfer the products. Oregon state law also contains provisions for caregivers. Caregivers are legally defined as individuals who provide assistance to patients in obtaining marijuana and managing its use. Caregivers must have an OMMP card and must be designated by the patient. Caregivers may not be paid for providing services and cannot possess more than six plants.
