Yes, according to health care law in Alaska, there are legal requirements for providing health care services to uninsured individuals. Under the Alaska Mental Health Trust Authority (AMHTA) uninsured individuals are entitled to receive certain health care benefits. These benefits are provided through the AMHTA’s Essential Benefits Package (EBP). The EBP covers services and treatments that are medically necessary for the treatment and prevention of mental illness and related conditions. This includes, but is not limited to, inpatient and outpatient medical services, psychiatric and therapeutic services, prescription drugs, psycho-social rehabilitation services, and behavioral health services. In addition, Alaska law requires certain hospitals to provide a minimum level of emergency medical care to uninsured individuals that do not qualify for Medicaid or other government programs. These hospitals must provide medically appropriate treatment for individuals who present to the hospital, regardless of whether they are able to pay for the services. This requirement is known as the Emergency Medical Treatment and Labor Act (EMTALA). EMTALA requires hospitals to screen, stabilize, and transfer individuals to an appropriate treating facility, if necessary. In general, Alaska law requires health care providers to provide necessary medical services to uninsured individuals. However, individuals must still be responsible for payment of their medical bills. Health care providers may choose to offer payment plans or discounts for uninsured individuals who cannot afford to pay in full. If individuals are able to pay, health care providers may seek reimbursement through the state’s Medical Assistance program.
