How does an HOA dispute resolution process work?
An HOA dispute resolution process is a way to settle disagreements between homeowners and their association. This process is put in place to help find a resolution that is acceptable to the involved parties and to prevent disagreements from escalating into larger legal issues. In Washington, the process begins with the homeowner filing a written complaint with the association. The complaint must include all the facts related to the dispute and any requested remedies. The board of directors is then required to consider the complaint, review the facts, and determine if the complaint is valid. If the board of directors determines that the complaint is valid, they must take action to resolve the dispute in accordance with their bylaws, regulations, and the Washington state code. This may involve the board of directors communicating with the homeowner to attempt to work out an agreement. If the parties cannot reach an agreement, the board may appoint a mediator or arbitrator to review the complaint and suggest a resolution. The board must notify the homeowner of the action taken to resolve the dispute and provide a written decision if the dispute is not resolved. The homeowner may appeal the decision within 30 days if they are not satisfied with the resolution. The appeals process is conducted through the Washington court system and depends on the docket time and resources available.
