How do I file a complaint against my HOA?
If you have an issue with your Homeowners Association (HOA) that you feel needs to be addressed, you should first file a complaint to the Delaware Real Estate Commission (DREC). To file a complaint, you will need to contact the DREC and provide information such as the name and address of your HOA, a description of the issue, and any other pertinent information. The complaint should be in writing and may be filed online. The DREC will review your complaint and determine whether or not there is a violation of Delaware law or regulation by the HOA. If a violation is determined, the DREC may work with you and the HOA to negotiate and resolve the situation. If the complaint is sent to the DREC and no violation is found, they will notify you of their decision in writing. You may then be able to work directly with the HOA on the issue. If it is not resolved, you have the right to bring your case before the Chancery Court. In this case, you’ll need to hire an attorney to represent you. To ensure that your complaint is properly addressed, it’s important to provide all the details requested by the DREC in your complaint and provide copies of any supporting documentation. Additionally, make sure to keep records, emails, and notes of any conversations with the HOA or representatives of the DREC.
