What is the process for initiating an HOA foreclosure?

In Tennessee, the process for initiating an Homeowners Association (HOA) foreclosure typically begins with the delinquent homeowner being sent a notice of a delinquent payment. The homeowner then has a certain amount of time to pay the delinquent amount. If the homeowner is unable to pay the delinquent amount within the specified time frame, then the HOA may move forward with the foreclosure process. The HOA must then give the delinquent homeowner a Notice of Foreclosure. This notice informs the homeowner that the HOA is initiating the foreclosure process. This notice must be sent certified mail and must include the amount of the delinquent payment and the date by which the payment must be received in order to avoid foreclosure. Once the payment has not been received by the specified date, the HOA must then file a complaint with the court. The complaint must include the amount of the delinquent payment and state that the homeowner has failed to pay within the specified time period. After the complaint is filed, the court will typically then issue a summons, which informs the homeowner that they must appear in court on a certain date to answer the charges of nonpayment of the delinquent amount. The court will then hear the case and make a determination as to whether or not the homeowner is indeed in default of payment. If the court finds that the homeowner is in default, the court can order the foreclosure of the property. After the foreclosure is ordered, the homeowner will then be required to turn over the deed to the property to the HOA.
