What is the right to freedom of movement and residence?
The right to freedom of movement and residence is a fundamental right in Human Rights Law in Florida. This right grants individuals the ability to move freely within the United States and from one US state to another, as well as from US to a foreign country or visa versa. In addition, it provides individuals with the right to choose where to live, either within a state or country or in another. In Florida, this right is provided by the Florida Constitution, which states that “[a]ll persons are free to travel throughout the state and to reside wherever they choose within its boundaries. Any citizen of the United States may become a resident of Florida and remain a legal resident here, subject only to applicable federal law.” The Supreme Court of the United States has also recognized the right to freedom of movement and residence in other decisions, such as in 1969 when it ruled that racial discrimination in housing was unconstitutional. This decision also granted individuals the right to live in areas and neighborhoods of their choice, free from discriminatory practices. This right has since been extended to other groups such as those covered by the Americans with Disabilities Act. The right to freedom of movement and residence is an important human right, and it serves as an important protection for individuals in their daily lives. It also ensures that individuals are able to enjoy their right to travel and live wherever they choose without excessive government interference.
