What is the European Convention on Human Rights?
The European Convention on Human Rights (ECHR) is an international treaty created by the Council of Europe to protect human rights and fundamental freedoms throughout the continent. It was developed in 1950 by the European Commission on Human Rights, and the Convention was signed by almost all Council of Europe states in 1953. The ECHR is focused on protecting individuals’ rights against government interference. It outlines several basic rights such as the right to life, to protection from torture, to freedom of expression, and the right to a fair trial. Every individual is also guaranteed the right to take their case to the European Court of Human Rights if they believe their rights have been violated. In Utah, the ECHR has an even more direct impact as most of the rights found in the Convention are enshrined in the Utah Constitution. This means that the rights outlined in the ECHR are enforced directly in Utah, and any violation of these rights is considered a violation of state law. Additionally, the state of Utah may not pass any laws that limit or restrict the rights outlined in the ECHR. The European Convention on Human Rights is an important document that protects fundamental human rights and freedoms throughout Europe and in Utah. It is a cornerstone of international human rights law and has far-reaching implications for guaranteeing the rights and freedoms of all people.
