How much money can I receive from a workers' compensation claim?

In West Virginia, the amount of money you can receive from a workers’ compensation claim is determined by the severity of the injury or illness and the number of weeks or months you are out of work. Generally, the amount of money you will receive depends on the amount of wages you were earning at the time of the injury or illness, and the amount of time away from work. If the injury or illness causes a total disability, you may be entitled to benefits for up to 500 weeks. If it is a partial disability, the amount of time may be shorter, depending on the severity of the injury and the expected duration of the disability. In addition to the weekly benefits, you may be eligible for a lump sum payment for any permanent damage or scarring that occurred as a result of the injury or illness. The amount of money you can receive as a lump sum payment is determined by a formula based on the type of injury or illness and the number of weeks of total disability. Other factors, such as the quality of medical care you received, may also be considered. There is also a cap of five hundred weeks on the amount of total disability benefits you can receive. In addition, you may also be able to receive reimbursement for certain medical expenses related to the injury or illness. If you receive any reimbursement for medical expenses, it will not count towards the maximum amount of benefits you can receive.
