How do countries enforce foreign judgments?

When a country wants to enforce a foreign judgment, it must first obtain a declaration from the court. This declaration states that the judgment is valid in the country and has the same effect as if it were handed down by the court in that country. After obtaining the declaration, the country then enforces the foreign judgment in the same manner as it would enforce a domestic judgment. For example, in California, the court may order the judgment debtor to pay a certain sum or it may order them to provide a remedy. If the judgment debtor does not comply with the court order, the court can issue a writ of execution. A writ of execution is an order given by the court to a sheriff or other law enforcement officer directing the officer to seize the judgment debtor’s assets to satisfy the debt. The court will usually set an amount that must be paid and provide a time frame for payment. If the debtor does not comply, the court may also order the seizure of their real estate holdings, or other property, for sale at a public auction. Another way that countries enforce foreign judgments is through diplomatic channels. In these cases, the foreign country will use diplomatic pressure to get the judgment debtor to comply with the judgment. Finally, countries can also enforce foreign judgments through international enforcement treaties. These treaties are agreements between countries that allow for the recognition and enforcement of judgments from another country. Each country that is part of the treaty must abide by the agreement and is obligated to recognize and enforce the judgment in accordance with the treaty’s language.
