What are the requirements for conducting international arbitrations?
In California, international arbitrations must comply with the California Arbitration Act (CAA). The CAA sets out the framework for parties to resolve disputes through arbitration. Under the CAA, all parties must agree to have the dispute resolved by arbitration, instead of through the court system. The CAA also sets out the requirements for arbitrators who will oversee the process. Arbitrators must be impartial and qualified to hear international disputes. They must be knowledgeable in the law of the governing state, and may even come from outside California. In some cases, they may be appointed by a court if the parties cannot agree on someone to oversee the proceedings. The arbitrator must also set the rules of the arbitration and ensure that all parties are aware of the rules and the procedures that will be used. The arbitrator will then hear the dispute and make a decision that is final and binding. Finally, the CAA provides that any award issued by an arbitrator must be enforced in a court of law. In addition, the arbitrator’s decision must be accompanied by a statement of reasons explaining the decision. This statement must be made available to the public. By meeting these requirements, international arbitrations in California can provide a fair and efficient way to resolve disputes.
