What are the time limits for filing an insurance claim?
In the state of Florida, the statute of limitations for filing an insurance claim depends on the type of claim you are filing. For first-party claims, which involve damage to property or personal injury, you must file within 5 years of the incident in question. Third-party claims, which involve another party’s property or person, must be filed within 4 years. In regard to medical claims, the time limits are a little different. Bills related to medical expenses must be submitted to the insurance company within 2 years of the date of service. If a lawsuit is necessary to resolve your insurance claim, you must file the lawsuit within the time limits of the legal claim. In Florida, this is usually 4 years.
