What is an insurance lien?

An insurance lien is a legal right that insurance companies have to recoup money paid out on claims in certain circumstances. In Arizona, an insurance lien is the right that an insurance company has to place a lien on a property for the amount they’ve paid out on a claim. These liens are often used when an insurance company pays for repairs due to damages caused by an accident or disaster, and the liens are placed until the insurance company is reimbursed with the money. Insurance liens are also sometimes used to ensure that the policyholder does not misuse the insurance money or causes further damage to the property. When an insurance company places a lien on a property, it must be done in accordance with Arizona state law. The lien must be properly documented and filed with the county recorder’s office, and the individual must be notified in writing that the lien has been placed. Once the lien is in place, the lien holder must be paid before the insurance company can legally release the lien. In addition, the insurance company can take certain steps to help ensure that the lien is paid, such as filing a court action to enforce their rights.
