What is a negligence claim?

A negligence claim is when someone was injured due to someone else’s carelessness, or negligence. In the context of insurance claims law in North Carolina, a negligence claim is used to help an injured person recover the damages that may have resulted from an accident. In order to file a negligence claim, the person must be able to show that the other party was at fault, or responsible for the accident. The person who was injured must be able to demonstrate that the accused party acted carelessly or irresponsibly in a way that would directly cause injury. This means that the accused party was in violation of a duty of care that would be expected of any reasonable person to protect others from harm. This could include failing to fix a hazard in a timely manner or not providing adequate warning about potential dangers. In North Carolina, the injured person must also prove that they have suffered actual damages as a result of the negligence. This can include physical or psychological harm, medical expenses, or lost wages due to an inability to work. Once the injured person has established that the other party was negligent, they can then make a claim for the damages they have suffered.
