What is a breach of contract claim?

A breach of contract claim is a legal claim that can be made when a contract has been broken. In the state of Mississippi, this type of claim is regulated by Insurance Claims Law. A breach of contract claim is made when one of the parties in a contract fails to fulfill their contractual obligations, either in whole or in part. For example, if one party fails to pay the other party as agreed in the contract, this would be a breach of contract. When a breach of contract occurs, the aggrieved party may bring a claim to the court in order to seek financial compensation for the damages caused by the breach. The damages caused by the breach of contract can be either compensatory damages, which are meant to cover the losses caused by the breach, or punitive damages, which are meant to punish the breaching party. In order to prevail in an insurance claims law case in Mississippi, the aggrieved party must demonstrate that all of the elements of a breach of contract claim have been established. These elements include the existence of a valid contract, the breach of contract by the other party, and causation, meaning that the breach of contract is the direct cause of the damages suffered by the aggrieved party.
