What is an assignment of rights?

An assignment of rights is a legal document that transfers certain rights from one individual, known as the assignor, to another individual or entity, known as the assignee. In the context of insurance claims law in South Dakota, assignment of rights typically occurs when a policyholder transfers their rights to receive an insurance payment to a third party, such as a medical provider or an attorney. The policyholder must sign the assignment of rights document, agreeing to give their rights to the third party, in order for the transfer of rights to be legally recognized. The policyholder’s signature must be notarized and the document must be filed with the court in order for it to be valid. The assignee must then comply with any requirements set forth in the policy in order to receive the insurance payment.
