What is an assignment of rights?

An assignment of rights is an agreement between two parties that allows one party to transfer their rights or benefits to another. In regards to insurance claims law in Washington, an assignment of rights is a legal document that transfers an insured person’s benefits, or rights, to a third party. This document allows the third party to act as if they are the insured person when making claims against the insurance company. For example, if the insured person is in the hospital and cannot declare their rights to their insurance company, they can assign their rights to a relative or friend who will act on their behalf. In general, an assignment of rights is a contract between an insured person and a third party that is usually prepared by an attorney or insurance broker. A well-written assignment of rights will include detailed information about the rights being assigned, including what the third party is allowed to do and the time period for which the assignment is valid. It should also include signature of both parties and the date the assignment is made. The assignment of rights must be signed and filed with the court in order for it to be considered valid.
