What is the penalty for committing identity theft?

In Wisconsin, identity theft is a serious crime, punishable by a variety of penalties depending on the circumstances. Generally, identity theft is considered a Class H felony and therefore faces a maximum penalty of 6 years in prison and a $10,000 fine. In addition, the defendant may be liable for court costs and restitution. In lieu of a prison sentence, the court may exercise its discretion and order community service, probation, a fine, or a combination of these. Other possible penalties include restitution for any losses the victims suffered as a result of the theft, payment of court costs, and/or a period of probation. If the identity thief has previously committed a felony or is a repeat offender, the court can impose an enhanced punishment. In these cases, the potential prison sentence faces a maximum of 12.5 years and a fine of up to $25,000. In addition, the court may require the offender to pay for any damages they caused and restitution to the victims. In addition, a conviction for identity theft can have long-term consequences. By law, the conviction will remain on the offender’s records for 10 years, impacting their ability to find employment, apply for loans and credit cards, or rent an apartment.
