What happens if my asylum application is denied?
If your asylum application is denied in Vermont, it means that you are not eligible for asylum in the U.S. and will be subject to removal from the country. Generally, Asylum applicants receive a notice of removal from the Vermont Asylum Office if their application is denied. In some cases, the removal may be deferred if the person has a valid argument as to why why they should remain in the U.S. This is known as a “deferral of removal” and it is determined on an individual basis. You may be able to appeal the denial of your asylum application, however, there are very strict criteria that must be met in order for you to be granted an appeal. If your appeal is denied, then you will be issued a Final Order of Removal, which means that you must leave the country within a certain timeframe. If you remain in the U.S. after being issued a Final Order of Removal, you will be considered an undocumented immigrant and may be subject to detention and deportation. It is important to note that if you are facing removal, it is in your best interest to seek assistance from an attorney who specializes in immigration law in order to determine the best options available to you.
