What is a “credible fear” interview?
A credible fear interview is a process used in Colorado Immigration Law regarding Asylum. This process is used by the US Citizenship and Immigration Services (USCIS) to determine whether a person seeking asylum has a legitimate fear of persecution if he or she were to return to their home country. In order to verify an individual’s claim of credible fear, they must pass a credible fear interview. During this particular interview, the USCIS determines the applicant’s eligibility for asylum and whether they have a well-founded fear of persecution based on race, religion, nationality, membership in a particular social group, or political opinion. The applicant is interviewed by an asylum officer from the USCIS and asked to provide detailed evidence of why they fear returning to their home country. In addition to presenting evidence or providing a detailed account of their story, the applicant must also demonstrate that their fear of persecution is reasonable to the standards of the USCIS. An asylum officer can approve the applicant’s claim of credible fear if they appear to meet the standards of the USCIS and Immigration Law. If the applicant does not meet the standards, they may be denied the process of obtaining asylum in Colorado.
