What is a “withholding of removal”?
A withholding of removal is a form of relief from deportation to another country that is offered by the United States. Under the Immigration and Nationality Act (INA), a person can request that the US government withhold removal of them to a foreign country. This means that the government can provide protection to someone who shows the US has a “clear probability of persecution” if returned to their home country. There are two types of withholding of removal that can be granted: Convention Against Torture and asylum. Convention Against Torture (CAT) can be applied to individuals who have experienced or fear they will experience torture if returned to their country of origin. Asylum is the second form of withholding of removal and can be applied to those who have experienced or fear they will be persecuted in their country of origin due to race, religion, nationality, social group, or political opinion. In New Hampshire, those requesting a withholding of removal must apply to the US Department of Homeland Security. The application must include proof of identity, proof of persecution, and proof of fear of persecution. Upon approval of the application, the individual will receive the protection of US laws and will not be removed to their country of origin, provided they keep up to date on their residency and comply with any conditions imposed by the government.
